Effective January 1, 2024: Board of Health Adopts New Private Well Regulations that Require PFAS and Water Quality Sampling prior to Sale of Property

The Nantucket Board of Health adopted new Private Well Regulations on 9/21/23, effective 1/1/24. See (Private Well Regulations- Chapter 386).  
 
The updated regulations included recommended language from the MassDEP “Model Board of Health Regulations for Private Wells” (Massachusetts Department of Environmental Protection) as well as language received during the public comment period.  
 
Effective 1/1/24, Chapter 386 (VIII) (4) “Water Quality Testing Requirements” requires private well testing for specific substances (including PFAS) prior to the sale of property per 386 (VIII) (9).
